Pool fencing rules in New Zealand

What the law actually asks of a residential pool barrier: heights, gaps, gates, the no-climb zone and when you need consent. Written plainly, current for 2026.

If you have a pool at home in New Zealand, the barrier around it is not optional and it is not loosely policed. The rules exist because a low fence or a self-latching gate that does not latch is the difference between a near miss and a tragedy. The good news is that the requirements are clear once someone lays them out, so here they are.

Which law applies

Residential pool safety sits inside the Building Act 2004 and Building Code Clause F9, Restricting access to residential pools. This replaced the old Fencing of Swimming Pools Act 1987 from 1 January 2017, folding pool rules into the wider building system. The standard that sets out acceptable barrier design is NZS 8500, Safety barriers and fences around swimming pools.

The rules apply to pools and spas capable of holding water more than 400mm deep, including in-ground, above-ground and many spa pools.

The key measurements

  • Barrier height: at least 1200mm measured from the finished ground level on the outside of the barrier to the top of the fence.
  • Gaps: no gap in or under the barrier may exceed 100mm, so a small child cannot squeeze through.
  • No-climb zone: there must be no climbable objects, footholds or horizontal rails on the outside that would let a child scale the barrier. Keep furniture, pot plants and pool pumps clear of it.
  • Gates: must be self-closing and self-latching from any open position, open away from the pool, and have the latch release positioned or shielded so a young child cannot reach it.

Glass suits these rules well. A frameless glass panel has no footholds at all, so it removes the climbability problem that catches out horizontal-rail fences.

Do you need building consent?

Yes. Installing or altering a pool barrier is building work that requires building consent, and the finished pool must be inspected. Auckland Council inspects residential pools on a regular cycle, generally every three years, to confirm the barrier still complies. A barrier that has drifted out of compliance, a gate spring that has failed or a new deck box parked against the fence can all be picked up at inspection.

What about spa pools?

Spa and hot pools can be treated differently if they have a compliant lockable cover that meets the standard, but many still need a barrier. Because the detail matters, confirm what applies to your spa before you assume it is exempt.
